Proof of Originality and Ownership
Copyright owners (or Performers in live performances) may affirm a Statutory Declaration or an Affidavit evincing:-
- subsistence of copyright (or performers' right) in the relevant work (or live performance); and
- ownership of such work (or the identity of the performer).
The Statutory Declaration or Affidavit is admissible as evidence in any proceedings under the Copyright Act, and should preferably be prepared with the advice and assistance of an IP attorney. Insertion of a copyright notice on work which qualifies for protection can serve as a warning against copying. The notice can be in a simple form such as the symbol © followed by the owner's name and the year of creation of the work.
