Priority Claim
TRADE MARK
An applicant may claim the filing date of an earlier application made by him or his predecessor in title in a foreign country (or the earliest foreign filing date if more than 1 foreign country is involved) as the priority date PROVIDED:-
that foreign country is a party to any multilateral treaty relating to trademarks to which Malaysia is also a party OR has arrangements with Malaysia for reciprocal protection;
The corresponding Malaysian application is made within 6 months from the filing date in that foreign country (or if more than 1 foreign country is involved, the earliest foreign filing date); AND
The applicant is a citizen or resident of, or a body corporate incorporated under the laws of that foreign country
INDUSTRIAL DESIGN
An application may claim the priority of 1 or more earlier national, regional or international applications filed by the applicant or his predecessor in title in any state (in which event, the priority date will be the earliest filing date of such earlier applications) PROVIDED:-
the state is a party to any international treaty or convention to which Malaysia is a party; AND
the corresponding Malaysian application is made within 6 months from the earliest filing date of such earlier applications.
